Welcome to OVACARS. By reserving or renting a vehicle through our website or directly with our team, you agree to comply with and be bound by the following Terms & Conditions, which comply with applicable Moroccan commercial regulations (Dahir formant Code des obligations et des contrats).
1. Driver Requirements & Eligibility
Minimum Age: Drivers must be at least 21 years of age to rent standard economy vehicles, and at least 25 years of age for premium/SUV models.
Driving License: Drivers must hold a valid national driving license that has been active for a minimum of 1 to 2 years (depending on the vehicle class).
International Visitors: Tourists may drive using a valid driving license issued by their home country, provided it uses the Latin alphabet, or an International Driving Permit (IDP).
Identification: A valid Passport and Driver’s License must be presented at the time of vehicle pickup. Copies will be made for contractual purposes; OVACARS does not hold physical passports or original IDs.
2. Reservation & Delivery
Delivery Locations: Vehicle pickup and drop-off are offered at Agadir Al-Massira Airport (AGA), local Agadir hotels, Taghazout, Tamraght, and designated coastal locations.
Vehicle Reservation: While we make every effort to provide the exact model selected, OVACARS reserves the right to supply a similar or upgraded vehicle in the same price class if unforeseen circumstances arise.
3. Pricing, Security Deposit & Payments
Payment Methods: Payments can be made via Cash (MAD, EUR, or USD upon delivery), Credit/Debit Card (Visa or MasterCard), or pre-arrival Bank Deposit/Transfer.
Security Deposit (Caution): A security deposit is required upon signing the official rental contract. This can be processed via credit card pre-authorization or a refundable cash deposit.
Deposit Refund: The security deposit is fully refunded or released upon vehicle return, subject to an inspection confirming no damage, missing accessories, or fuel discrepancies.
4. Cancellation & Refund Policy
Free Cancellation: You may cancel or modify your reservation free of charge up to 48 hours prior to your scheduled pickup time for a 100% refund of any advance booking deposit.
Late Cancellation / No-Show: Cancellations made within 48 hours of scheduled pickup or no-shows are subject to a fee equal to 1 day’s rental rate.
Early Returns: Per standard Moroccan car rental practices, unused rental days are non-refundable if a vehicle is returned earlier than agreed in the signed contract.
5. Fuel & Vehicle Usage
Fuel Policy: Vehicles are provided with a noted level of fuel (e.g., Same-to-Same) and must be returned with the same fuel level as recorded in the pickup inspection report (état des lieux). Unreturned fuel is non-refundable.
Geographic Limits: Vehicles may only be driven within the national borders of Morocco. Off-roading, beach driving, rally driving, or driving on unpaved non-designated tracks is strictly prohibited.
Prohibited Use: Vehicles must not be used for illegal activities, sub-leasing, towing, or driving under the influence of alcohol or controlled substances.
6. Insurance & Roadside Assistance
Basic Coverage: Standard collision and third-party liability insurance are included with every rental contract.
Customer Responsibility: Damage caused by gross negligence, unauthorized drivers, off-road usage, or driving under the influence is not covered by insurance and remains the full financial responsibility of the renter.
24/7 Roadside Assistance: OVACARS provides 24/7 customer support and breakdown assistance across Morocco. In the event of an accident or breakdown, the renter must contact OVACARS immediately and obtain an official police report (constat amiable or police report).
7. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising from the interpretation or execution of these terms shall be submitted to the competent courts of Agadir.
